A massive $1.61 million class action settlement has been reached with Krispy Kreme Doughnut Corporation following a major cybersecurity incident. If you received a data breach notice regarding this incident, you could be eligible for a significant cash payout or free credit monitoring—but the clock is ticking to claim your share.

What Happened?

The lawsuit stems from a cyberattack discovered on November 29, 2024, which compromised the highly sensitive private information of approximately 161,676 individuals (primarily current and former employees, alongside select consumers).

According to the litigation (In re: Krispy Kreme Data Security Litigation), the data breach exposed a deeply concerning mix of personal data, including:

  • Full names and dates of birth

  • Social Security numbers (SSNs)

  • Financial account access information

  • Driver’s license or state ID numbers

Plaintiffs alleged that Krispy Kreme failed to implement reasonable, up-to-date cybersecurity measures that could have prevented the infiltration. While Krispy Kreme denies any legal wrongdoing or liability, they agreed to the $1,616,760 settlement to avoid the mounting costs and unpredictability of an ongoing trial.

Eligible class members have two mutually exclusive monetary options when filing a claim, alongside automatic non-monetary benefits.

Note on Cash Payouts: Both the $3,500 cap and the $75 flat fee are subject to pro rata adjustments. This means individual payouts may increase or decrease proportionally depending on the total number of valid claims submitted.


 


Important Deadlines & Next Steps

If you are an affected United States resident who received a mailed notice containing a unique ID and PIN, you must act quickly to secure your rights.

1.Decide on Exclusion or Objection:Deadline: June 6, 2026.

If you wish to opt out of the settlement to preserve your right to sue Krispy Kreme independently, or if you want to object to the terms of the deal, your paperwork must be postmarked by this date.

2.Submit a Claim Form:Deadline: June 22, 2026.

To receive either the $75 flat cash or up to $3,500 for documented losses, you must submit a valid claim form online at KrispyKremeDataSettlement.com or via mail before midnight.

3.Await Final Court Approval:Hearing: July 6, 2026.

U.S. District Judge Max O. Cogburn Jr. will preside over the final fairness hearing in Charlotte, North Carolina, to officially approve the settlement.

4.Receive Compensation:Timeline: Late 2026.

Approved funds and cash payments will be systematically issued by the settlement administrator roughly 75 days after final court approval, assuming no legal appeals are filed.
